These terms govern your use of the Quark Marketing listing optimization service. By connecting your Amazon selling account or using the service, you agree to them.
The Service
Quark Marketing provides software that reads your existing Amazon product listing content and generates suggested improvements to titles, bullet points, and descriptions. The service may apply approved changes back to your Amazon listings on your instruction.
Authorization and Access
You grant Quark Marketing access to your Amazon selling account through Login with Amazon. You may revoke that access at any time from Seller Central, under Apps and Services. Revoking access ends our ability to read or modify your listings immediately.
You must be authorized to grant this access for the selling account you connect. If you connect an account on behalf of a client, you confirm that you have their permission to do so.
Your Responsibilities
The service generates suggestions. You decide what to publish.
- You are responsible for reviewing generated copy before applying it to your listings
- You are responsible for the accuracy of your product claims and listing content
- You are responsible for compliance with Amazon’s listing policies, style guides, and category requirements, and with all laws applying to your products
- You must not use the service to create misleading, infringing, or prohibited listing content
Acceptable Use
You may not resell, sublicense, or provide access to the service to third parties without our written agreement. You may not attempt to access accounts or data that are not yours, reverse engineer the service, or use it in a way that breaches Amazon’s own policies or terms.
Fees
The service is provided on a subscription basis. Applicable fees, billing period, and payment terms are those presented to you when you subscribe. We will give notice before any change to fees takes effect.
Your Data
How we handle your information, including data retrieved from Amazon, is described in our privacy policy, which forms part of these terms.
No Warranty
The service is provided as is. We do not warrant that generated copy will increase sales, traffic, conversion, or search ranking, or that it will be accepted by Amazon. AI-generated suggestions may contain errors, which is why you review them before publishing.
Limitation of Liability
To the extent permitted by law, Quark Marketing is not liable for indirect or consequential losses, including lost sales, lost profits, or account suspension arising from listing content you chose to publish. Our total liability for any claim is limited to the subscription fees you paid us in the twelve months before the claim arose.
Suspension and Termination
You may stop using the service and revoke access at any time. We may suspend or end access if these terms are breached, if required by Amazon, or if continued operation would put other users at risk. On termination we delete your data as described in the privacy policy.
Changes to These Terms
If we change these terms we will update the date at the top of this page and notify subscribers by email of material changes.
